1. General / Scope

The following General Terms and Conditions shall apply exclusively to the business relationship between PlanetBid and its internet platform (hereinafter: "PlanetBid") as well as our users in the version applicable on the date of use. By participating in PlanetBid the user accepts the following General Terms and Conditions, as well as the manner in which PlanetBid and its "AutoBidder" operate as described on our website. PlanetBid does not recognise any terms and conditions set by the user that differ from these unless PlanetBid has agreed to their validity in writing.

2. Patents and Intellectual Property

Patents, with the exception of international patents, will only be recognised within the country in which they are granted in. PlanetBid respects intellectual property and patents, registered within Australia. Only patents registered in Australia will be recognised and should any patent fall into Australian jurisdiction we will respect said patents. PlanetBid's Internet assets are located in Australia and are not subject to patent laws from other countries.

If you believe your intellectual property or patents are being infringed by PlanetBid please send an email to info(at)PlanetBid.com.au - You will need to include full details of how you believe the patent has been infringed. If your patent is pending, published or granted within any country apart from Australia , please DO NOT email us as ALL email regarding pending, published or granted patents will be IGNORED as will all copyright requests that are not registered in Australia. PlanetBid fully respects and will abide by the patent laws of Australia.

We believe our site is legal in all countries and that our coding functions are completely different to other sites of this nature. Equally, copyright is individual to a particular site. PlanetBid is copyrighted and the copying of any material is not allowed UNLESS permission has been given by us in writing. We believe our site has not infringed any copyright material from other sites.

References to auction items listed on the site may be copyrighted and patented - These are acknowledged and owned by the relevant manufacturer.

3. Geographical Trading

Our business is located and operated within Australia - We will endeavor to ensure trading is limited to countries that are deemed to be Patent free for sites of this nature.

However bearing in mind - due to the nature of the internet, it is not always possible to restrict access from all countries and users identities are often harder to verify.

PlanetBid makes no guarantees that a user identity is correct. As a user of the site you are required to supply us with accurate contact details, delivery address and any other information required.

Any user found to be falsifying recorded details will then have their account immediately suspended and pending an investigation, may be removed from the site permanently. There will be NO refund of bids or Bid Credits or other monies if an account has been suspended or excluded.

PlanetBid will NOT tolerate fraud of any kind - IP addresses will be logged for payment transactions and details held on our system for a user committing fraud will be passed onto the relevant authorities.

4. Promotions

Promotions presented by PlanetBid shall only be valid if they are announced on PlanetBid website or by newsletter. Upon expiration of the time limit stated, or after the auction(s) that are part of the particular promotion has/have ended, the promotion is ended.

Commentary and other materials posted on the PlanetBid website are not intended to amount to advice on which any credibility can be placed. PlanetBid disclaims to the fullest extent permitted by law all liability and responsibility arising from any reliance placed on such materials by any visitors to the PlanetBid website or by anyone who may be informed of any of its contents.

5. Eligibility to Participate / Registration with PlanetBid / Disqualification

By placing an order through the PlanetBid the user warrants that they are legally capable of entering into binding contracts, and that they are at least eighteen (18) years of age.

Employees and relatives of employees of PlanetBid are not eligible to participate in the bidding under any circumstances

Registered users can use the full functionality of "PlanetBid". PlanetBid therefore recommends that all users register with "PlanetBid". Each user may register only once under their postal address (only the actual residence, other forms of address will not be considered valid). The user can later change his/her billing address under "My Addresses" to be different from the postal address. Additionally, only one user registration per household is permitted. During the registration process, the user must choose a user name. This user name may not offend common decency or infringe upon the rights of third parties. The associated password should be kept secret by the user. User accounts created during registration are non-transferable. Any abuse of the user account, be it to the detriment of third parties or to the detriment of PlanetBid, shall inevitably result in the disqualification of the user and the report of a crime. The user is liable for all activities that are undertaken using the user account together with the associated password.

PlanetBid is free at any time to temporarily or permanently disqualify a user. Users will be disqualified when in the reasonable opinion of PlanetBid they have violated statutory provisions or the rights of third parties. A disqualification may also occur if PlanetBid has another justified interest in such for the protection of other users or to prevent manipulation or use of PlanetBid. Examples of such unauthorized usage include (but are not limited to) non-payment of bids, use of unauthorised bidding software, users colluding or set up of multiple user accounts by same individual.

PlanetBid reserves the right to limit the number of auctions a user may participate in or the number of his successfully finished auctions at its sole discretion.

6. Bid Purchasing for Online Bidding / Payment

Bidding rights, so-called "bids", have to be purchased by users prior to commencing online bidding. Only registered users can submit the online bids, which can be purchased in packages (so-called "Bid Packages") at the currently applicable prices, which can be viewed in "Account" under "Buy Bids" or in home page under “Bid packages”. The bids must be paid for in advance. When the bids are purchased and deposited into the user's PlanetBid account, a contract for the purchase of the bids materialises.

Payment can be made via credit/debit card or trough payment agents such as Paypal or other payment agent we use at the given moment.

Should a payment not be honored for a user, a returned payment fee will be charged. Solely the user shall be responsible for these fees. PlanetBid reserves the right to ban access to the user account until payment in full of the invoice amount, including any additional fees, and to withhold any outstanding deliveries until payment is made in full. 

PlanetBid does not take responsibility for direct or indirect damages & consequential losses suffered by use of fraudulent or unauthorised credit cards.

Several bids (e.g. “free bids“, “special offers”) have time limit. Upon expiration of the time stated, the bids expire and can no longer be applied. There will be no refund in this case. The same applies for certain discount codes used.

There will be no refund available once bid credits have been purchased. This extends to unused bid credits also not being refundable.

PlanetBid operates using US dollars for its global  website www.planetbid.com.

7. Bidding / AutoBidder 

For online bidding, an individual bid can be submitted by clicking on relevant bid buttons, or the AutoBidder can be used. Once a bid is submitted it is no longer valid and is deducted from the user's account accordingly.

PlanetBid reserves the right of the use of autobidders. The AutoBidder assists bidders in being able to bid in an auction even if they are not online at that time. Only registered users can submit bids automatically with one or more AutoBidders. The AutoBidder automatically submits bids in compliance with the specifications set in advance by the user.
When setting up an AutoBidder, users enter the price they wish for our systems to automatically start bidding for them, and a price they wish the computer to stop bidding.

The user is prohibited from using bidding software not authorised by PlanetBid, if found to be using bidding software, immediate disqualification will be applied.

If two autobidders end at the identical time of an auction the winner of the auction is determined by the current 'latest bidder'.

8. How the Auctions Work

With each bid submitted the price of the item on which the user is bidding increases by amount specified. With each bid submitted the timer will increase to allow other bidders a chance to bid. PlanetBid reserves the right to change the time and price increment at any time. A bid submitted by the user constitutes willingness of a user to enter into a binding contract with PlanetBid and in the event of successful finishing an auction the claim to receive a purchase offer for the item of the auction under the conditions set out in the related auction. A contract to purchase the item does not come into effect until the auction is finished and the last bidder has followed all the steps in clause number 9.

The remaining time for each of the auctions is shown on the screen. Auction ends when no more bids are submitted within the remaining time stated. The user who is the last to bid wins the auction. All other bids on the item expire and will not be refunded. The last bidder is determined based on the records in PlanetBid database and PlanetBid's decision regarding who is the last bidder shall be final.

9. Notification of the Win / Payment

After the auction has ended, the last bidder (“winner”), who is logged in will see “Things to do: Pay for the auction” under “Account”.

The winner will also receive a notification of the win by e-mail with a request for payment.

The user must pay the total price (auction price plus shipping costs) no later than 7 days after the notification of the win is sent. After this deadline has passed, PlanetBid can declare a rescission of the purchase contract to the user, which results in the user's right to delivery of the item being permanently revoked. There is likewise no entitlement to replacement of the bid used.

The item is not sent to the user until the total price has been paid to PlanetBid. A similar requirement for delivery is that all bids purchased and used by the user have been properly paid for. Should bids that have already been purchased and used not have been paid for, payments received shall be viewed as payment toward the bids not yet paid for, and a right of retention shall be exercised with regard to the item purchased at auction until all bids and the total price have been paid for in full. PlanetBid reserves the right to charge the winner reasonable storage charges for the items not paid for.

If in the event we do not accept a user's offer to purchase a product, PlanetBid will immediately send the user a refund and credit your account for all bids used by you on that auction.

10. Cancellation / Rescission

PlanetBid grants to the User ordering for personal purposes the right to cancel in accordance with statutory provisions on mail order sales and e-commerce.

The right to cancel does not exist in the case of mail order sales and e-commerce contracts for the delivery of audio and video recordings or of software, if and to the extent that the seal on the delivered media has been broken by the consumer but this does not affect the consumer’s other rights.

Contracts with parties who are not consumers are treated by PlanetBid as international supply agreements and, therefore such parties do not have rights to cancel concluded contracts (unless agreed to in writing by PlanetBid or required by law).

Cancellation Instructions.

You may cancel your contract within two weeks in written form (e.g. letter, fax, e-mail) or by returning the items, without stating your reasons. This period is extended to one month if you are not informed of these instructions until after you have concluded the contract.

The period begins no earlier than when the item and these instructions are received. To meet the deadline, it is sufficient to send the cancellation notice or return the item in a timely manner. Consequences of Cancellation.

In the case of a valid cancellation, both parties must return what has been received in performance of the contract and the benefits derived there from (e.g. interest) as applicable.

If the User is unable to return to us the service or product you received or are only able to return it in part or only in a depreciated condition, the User will have to pay compensation to PlanetBid, as applicable, unless the deterioration resulted from proper use.

In the case of use of items, this shall not apply if the deterioration of the item is attributable solely to it being tested, as it would be possible for the User to do in a retail store.

In other respects, the User may avoid this duty to pay compensation by not using the item(s) as the User would its own property, and by refraining from any action that would detract from its value. Items that can be shipped in packages are to be returned. In these cases, return is free of charge for the User. Items that cannot be shipped in packages will be picked up upon co-ordination with the User. The User must satisfy obligations to refund payments within 30 days after sending notice of cancellation.

When the User has cancelled by the deadline, he/she are not obligated to take delivery. PlanetBid will refund any purchase price already paid. There is no entitlement to replacement of the bid used.

The customer is to pay the costs for the return shipment if the item delivered matches that ordered.

Should PlanetBid incur additional costs for insufficient postage on the return, for a COD shipment, or for courier shipments and other irregular shipping methods that are over and above postal shipping costs, these costs will be deducted from any payment remitted by the customer. Sets/boxes can only be returned in their entirety.

11. Delivery

Delivery shall be made from our supplier's warehouse or from our warehouse to the address provided by the user unless otherwise stated.

PlanetBid  currently has suppliers in following countries: Australia, New Zealand, Canada,  Germany, Japan, France, China,Singapore, Hong Kong and Maylasia.

U.S. – deliveries made to U.S. delivery addresses in the 50 states only, including Alaska and Hawaii. Geographic shipping restrictions may apply to particular products; for example, some Tools & Hardware items may not be shipped to Alaska and Hawaii.
UK- deliveries made to addresses within England, Northern Ireland, Scotland, Wales and all BFPO addresses (including the Isle of Man and the Channel Islands)

In order to receive won item user has to provide shipping address in one of the above addresses.

Statements regarding delivery deadline are not binding insofar as the delivery date has not been committed to as an exception. PlanetBid shall be entitled to involve third parties to satisfy its contractual obligations without being required to notify the buyer. Obvious damage to the item from transport or packaging damaged during transport is to be reported to the supplier upon taking delivery.

Should PlanetBid not be able to deliver the item ordered, and this is not the fault of PlanetBid due to the fact that the supplier has not satisfied its contractual obligations to PlanetBid or does not do so in a timely manner, PlanetBid shall be entitled to declare rescission to the user or to substitute the item with a comparable replacement product with the same or better features. The user's rights under the law shall not be affected hereby.

12. Offsetting / Withholding Payment / Retention of Title

The user shall only have the right to offset if his or her counterclaims have been upheld by a court of law or are not disputed by PlanetBid.

The user shall only be entitled to exercise a right to withhold payment to the extent that his or her counterclaim is based on the same contractual relationship.

The item delivered shall remain PlanetBid's property until payment in full of the total price, including for the bids used in the auction. Until such time as payment has been made in full the user undertakes to store the item separately from their other possessions and to insure it. PlanetBid shall have full rights of access to the place where the item is located during normal business hours to take possession of it.

13. Damages / Reimbursement of Expenses / Limits on Liability

 PlanetBid does not warrant that our website will be error free or uninterrupted. Our services are distributed on an "as is" basis without warranties of any kind, either expressed or implied. PlanetBid will not be responsible for any losses, damages or costs that user may suffer when using the website or service. User agrees to indemnify and hold harmless PlanetBid from any claims resulting from the use of the website or service. User  expressly agrees that use of the website or service is at his/her sole risk. Neither PlanetBid nor its service providers, agents, licensors, employees shall have any liability for any damages suffered by user or any other party as a result of the use or misuse of the service.

 Claims for damages by the user against PlanetBid, its legal representatives, employees, vicarious agents or parties who assist in performance are prohibited.

PlanetBid shall not be liable for faulty operation of the users computer during bid submission and for incorrect or overly slow transmission of bidding data by internet provider. Should such an event occur, the bidder shall have no legal right to the purchase/receipt of the item.

This shall not apply in the case of damage that is due to the deliberate or grossly negligent conduct of PlanetBid, its legal representatives, or parties assisting it in performance. This shall also not apply if the guarantee for an item's features was expressly provided by PlanetBid in writing or a defect was fraudulently concealed.

Insofar as PlanetBid is insured for its liability for any damage, PlanetBid can also assign any entitlement to insurance settlement to the injured party. The user shall be obligated to accept this assignment.

Liability for reimbursement of expenses shall likewise only be assumed in accordance with the stipulations above.

Liability for damage arising from loss of life and limb, health, or well being, and that according to product liability law shall not be affected hereby.

All attempts will be made to ensure the site is functional - But at times we may be testing due to relocation or upgrading - If this is the case, then all bids are null and void and any money collected will be refunded

14. Guarantee

The items are supplied on the basis that they are reasonably fit for any reasonable purpose to which the winner may put them but subject as provided below all other warranties or conditions (whether express or implied) as to quality, condition or description (whether statutory or otherwise) are excluded to the fullest extent permitted by law.

PlanetBid reserves the right to assert damages under the conditions set down by law.

15. System Outage / Temporarily Halted Auctions

A system outage has occurred if no bids can be submitted for items due to an unforeseeable disruption in a system. In such case, the remaining times for the auctions and the established amounts of bids and the auctions will be temporarily halted. After the disruption has been eliminated, the auctions will be continued. Temporarily halted auctions are clearly indicated. Bidders who are bidding on temporarily halted auctions shall have no right to a refund for bids used or other costs incurred.

With the current state of the art, it is not possible to develop and operate computer programs (software) and data processing systems (hardware) completely without errors, or to rule out any unpredictable events in connection with the Internet as a medium (hereinafter referred to in brief collectively as "technical faults"). PlanetBid therefore provides no guarantee for the constant and uninterrupted availability of its website and technical systems. In addition but not subject to the provisions of clause number 13, PlanetBid shall not be liable for any damage whatsoever incurred by auction users or third parties from using PlanetBid's services. In particular, PlanetBid shall not be liable for damage that occurs due to bids submitted by auction users not being received by PlanetBid or not being received promptly or not being considered as a consequence of technical faults.

Should a technical problem occur, affecting the PlanetBid auction platform, the countdown timers for all live auctions will be paused until the issue has been resolved. Auctions will continue as the system is brought back up. The auctions will be restarted from the same time they were prior to the technical problem.

Alternatively, PlanetBid has the right to restart all auctions, as the technical problem(s) has (have) been rectified. Should PlanetBid suspect that an unlawful action(s) or action(s) against its terms and conditions brought the service down; it has the right to investigate the matter during up to 3 months.

In cases, which involve technical problems, PlanetBid may attempt to return purchased bids (no free bids) placed particularly for those auctions that took place prior to the technical problem. However, this only relates to bids that were placed on auctions that were live as the technical problem occurred and thereafter were restarted.

6. Applicable Law / Severability Clause

Australian law shall apply and shall exclude application of the UN Convention on the International Sale of Goods. To the extent legally permitted, the place of jurisdiction is Sydney, Australia.

18. External Links

PlanetBid website may contain links to other websites operated by third parties, and these sites may likewise contain links to other websites. Despite conducting careful checks, we assume no liability for the content of external links. The operators of the sites linked to and from this site are solely responsible for their contents. We hereby expressly distance ourselves from all content of any and all websites linked to the PlanetBid website. We cannot take any responsibility for the content of the data protection guidelines of third-party websites.

19. General

The contract between PlanetBid and users is binding on the parties and on their respective successors and assigns. The user may not transfer, assign, charge or otherwise dispose of any contract formed under these General Terms and Conditions or any of their rights or obligations without PlanetBid's prior written consent.

PlanetBid has the right to revise and amend these General Terms and Conditions from time to time in its absolute discretion but for reasons including but not limited to changes in market conditions affecting PlanetBid's business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in PlanetBid's system's capabilities. All users will be subject to the policies and terms and conditions in force at the time that they have successfully bid for items listed on the PlanetBid website, unless any change to such policies or terms and conditions is required to be made by law or governmental authority or PlanetBid notifies its users of the changes to such policies or General Terms and Conditions before PlanetBid sends information relating to dispatch (in which case PlanetBid has the right to assume that all successful winners have accepted the changes to the terms and conditions unless notified to the contrary with 7 working days by the user of the items).

PlanetBid is the owner or licensee of all intellectual property rights on the PlanetBid website and the material published on it. Those works are protected by copyright laws and treaties around the world and all rights relating to the same are reserved. Users may print off one copy and may download extracts of pages for personal reference only. Users may not modify any paper or digital copies of any materials printed of or downloaded. Users must also not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Users must not use any part of the materials on the PlanetBid website for commercial purposes.

 20. Responsible Bidding.

Planet Bid is a reverse auction site where users have to pay for the right to bid on an auction.  There is a fee for placing bids on item. This fee allows us to give away items for a fraction of the actual retail price. Planet Bid is meant to be fun way of grabbing a few bargains, not a substitute for purchasing the item itself. Due to multiple users bidding on the same item there is no guarantee that everyone can win.

Due to the billing of charges, we would like to advise all users to monitor their bidding practices. Repeated online bidding can incur high costs. Users should therefore pay attention to their bidding practices.
